TEMPUR-PEDIC® "TEST DRIVE EVENT" OFFICIAL RULES

1. Game Period: Game begins at 12:01 am EST on 4/23/09 and ends at 11:59 pm EST on 5/31/09.
2. To Play: When a consumer tests a Tempur-Pedic mattress at any participating Authorized Tempur-Pedic retail showroom, they will receive a game piece, available while supplies last. With the side of a coin, the consumer will gently scratch-off the hidden area.  When the code has been revealed, the consumer must visit www.ExperienceItAndWin.com, a website owned by Tempur-Pedic and operated by R solutions, and follow the on-screen instructions to find out if the game piece is a winner.  In-store Game Piece distribution limited to ONE (1) Game Piece per consumer. One game code entry allowed per unique consumer email address.  If the consumer does not have internet access, they can call 877-735-9280, during the hours of 8:00 am EST and 5:00 pm EST, to have their game code checked.  Game Pieces available while supplies last.  All eligible entries, regardless of winning or nonwinning status, will be entered into a drawing at the end of the promotion for the Grand Prize.
3. Alternate Means of Entry: For a free game piece, send a self-addressed, stamped #10 envelope to: Tempur-Pedic Test Drive Event, P.O. Box 221002, Cleveland, Ohio 44122. Vermont and Washington residents may omit return postage. Requests for free game piece must be received by 5/15/09. Limit one request per entrant.  A product purchase WILL NOT AFFECT YOUR CHANCES OF WINNING A GAME PRIZE.
4. Eligibility: Game is open to residents of the United States who are 18 years of age or older except residents of Puerto Rico and where legally prohibited. Game pieces are available while supplies last. One game code entry allowed per unique consumer email address. Employees of Tempur-Pedic (“Sponsor”), their distribution/retail network, their franchisees and their respective partners, affiliates, subsidiaries, advertising and promotion agencies, game piece suppliers or judges (collectively "Game Parties") and any other individual or company involved in the development or execution of the game at any time during the Game Period and the immediate family members and/or those living in the same household of each are not eligible.

5.  General Game Rules:

a.       Sponsor and Game Parties are not responsible for incomplete, lost, late, damaged, illegible or misdirected mail or for any technical problems, malfunctions of any telephone lines, computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Sponsor and Game Parties are not responsible for any damage to any participant's computer system/software related to or resulting from participation or downloading any materials in this promotion. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.  ANYONE INTENTIONALLY DAMAGING OR ATTEMPTING TO MUTILATE OR ALTER ANY GAME PIECE, MANIPULATE OR CAUSE DAMAGE OR INTERRUPTION TO SPONSOR'S COMPUTER OR COMMUNICATIONS SYSTEMS, OR OTHERWISE CAUSE ANY INTERRUPTION TO THE LEGITIMATE INTERRUPTION OF THIS PROMOTION WILL FORFEIT ANY PRIZE WINNINGS FROM THIS GAME. 

b.      In the event of a dispute regarding any entry, the entry will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry (i.e., the person who is assigned to an e-mail address by an Internet access provider, on line service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address). 

c.       If, for any reason, the Game cannot be conducted as planned by reason of infection by computer virus, unauthorized intervention, technical failures, or any other causes beyond the control of the Sponsor which, in the sole opinion of the Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this game, the Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the game.

d.      All federal, state and local taxes, insurance, licensing, registration and title fees are the sole responsibility of winners. All federal, state and local laws and regulations apply to this game.

e.       All prize winners may be required to complete an Affidavit of Eligibility/Release of Liability and, if legally permissible, Publicity Release within 14 days of notification as a condition to receipt of their game prize.  Noncompliance within this time period or return of any prize/prize notification as undeliverable may result in disqualification. Acceptance of prize constitutes permission to the sponsors and their agencies to use winner's name and/or likeness for purposes of advertising and trade without further compensation, unless prohibited by law.

f.       Prizes are non-transferable and non-cash prizes have no cash redemption or equivalent. Sponsor reserves the right to substitute a prize or prize component of equal or greater value should a prize or any component of a prize become unavailable.

g.       By participating in this game, entrants agree to be bound by the Official Rules and the decisions of the judges.

a.       and each of their respective parent companies, affiliates, subsidiaries, officers, directors, representatives, agents and employees), from any and all liability whatsoever for any injuries, losses or damages of any kind arising from or in connection with, either directly or indirectly, (1) the awarding, acceptance, receipt, possession, use and/or misuse of any prize awarded herein; or (2) participation in the game or any prize related activities. Sponsor and Game Parties make no representation or warranties concerning the appearance, safety or performance of any prize awarded. Sponsor and Game Parties are not responsible for late, lost, damaged, incomplete, illegible, postage due or misdirected mail.

b.      Sponsor may collect your name, address, phone number and e-mail address for purposes of administering your participation in this game. At the time you are entering the game, we may also ask your permission to send you future marketing information from Tempur-Pedic. Game participants will be provided an opportunity to opt out of receipt of this marketing information or from the sharing by Sponsor of your personal information with our promotional partners or other third parties.

c.       Grand Prize drawing to be held on or about June 5, 2009.

6. Verification: All game piece claims are subject to verification by R solutions, LLC., an independent judging organization whose decisions are final. All material submitted becomes the sole property of the Sponsor and will not be returned. Any game piece that is illegible, mutilated, altered, duplicated, tampered with, forged, cut, torn, contains printing, typographical or other errors will be null and void. Only Official Game Pieces obtained via Rule #2 and/or #3 shall be deemed to have been obtained legitimately. Game pieces which are distributed where prohibited by law or not obtained pursuant to official game rules and procedures will be null and void.
7. Prizes: GAME PRIZES, APPROXIMATE RETAIL VALUES & APPROXIMATE ODDS OF WINNING (ODDS ARE BASED ON ALL AVAILABLE GAME PIECES BEING DISTRIBUTED AND UNCLAIMED PRIZES WILL NOT BE AWARDED).  ALL CASH PRIZES AWARDED IN THE FORM OF A CHECK:

a.       (1) Grand Prize – 2009 or Newer Ford Mustang Convertible V6 – MSRP $25,995 (Odds Dependent Upon Total Number of Entries Received);

b.       (5) Cash Prizes - $1,000 each (Odds - 1:610,000);

c.        (10) Cash Prizes - $500 each (Odds – 1:305,000);

d.      (200) SymphonyPillow Queen – (ARV $129) (Odds – 1:15,250)

e.       (200) ComfortPillow Queen – (ARV $159) (Odds – 1:15,250)

f.       (300) All-PurposePillow – (ARV $49) (Odds – 1:10,167)

Prizes consist only of those items specifically listed as part of the prize. Any expenses not specified herein (including but not limited to income tax, maintenance and all other costs incurred in claiming prize) are the sole responsibility of the winner.  In the event of unavailability of any Game Prize, Game Sponsor reserves the right to substitute a prize of equal retail value selected in its sole discretion.
